Injury Victim Can't Recover From Estate

A Massachusetts resident was unsuccessful in bringing a personal injury claim against a decreased homeowner’s estate. The plaintiff says that bad maintenance of his property when the defendant was alive caused an accident just a couple of months after his death.

The personal injury victim brought suit because the deceased knew about the hazard on his property and did not repair the discrepancies prior to his death. For this reason, the estate should cover the damages for this mishaps.

The court in Massachusetts failed to agree with the plaintiffs claim. The court states that the homeowner can not correct an issue after he has passed away. The court also stated that the length of responsibility on material assets seize when a person is decreased.
